1. Compliance with Regulations

By using our services for Application-to-Person (A2P) messaging, you agree to comply with all applicable laws, regulations, and guidelines set forth by regulatory bodies governing messaging and telecommunications. This includes, but is not limited to, compliance with A2P 10DLC (10-Digit Long Code) requirements, carrier guidelines, and any other related regulations.

2. Responsibility for Fines and Penalties

You acknowledge and agree that you are solely responsible for any fines, penalties, or charges imposed by carriers, regulators, or other authorities due to your non-compliance with the applicable laws and regulations governing A2P messaging. This includes any fines related to improper content, spam, or misuse of the messaging services.

3. Obligations to Follow Best Practices

You agree to follow industry best practices for A2P messaging, including obtaining proper consent from recipients, providing clear opt-out mechanisms, and ensuring that your messaging content complies with all applicable legal requirements. Failure to adhere to these practices may result in the suspension or termination of your services.

4. Indemnification

You agree to indemnify, defend, and hold our company harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of our A2P messaging services, including but not limited to any breach of these terms and conditions or non-compliance with applicable laws.

5. Service Suspension and Termination

We reserve the right to suspend or terminate your access to our A2P messaging services in the event of any breach of these terms and conditions or if we suspect any non-compliance with applicable regulations. Such suspension or termination may occur without prior notice and at our sole discretion.

6. Amendments to Terms and Conditions

We reserve the right to amend or update these terms and conditions at any time to reflect changes in regulations, industry standards, or our service offerings. Any changes will be communicated to you, and your continued use of the services constitutes your acceptance of the updated terms.
